FILAMENT JOURNAL SUBMISSIONS

Thank you for your interest Zinc Learning Labs’ (“Zinc”) Filament online journal. The following terms and conditions govern your submission of your writings and images of your works of visual art for potential publication in Filament.

1. Who May Submit:  Any current middle or high school student over the age of 13, whether or not they are currently working with Zinc, may submit an original essay, poem or story (“Essay”) or a high resolution image of an original work of visual art such as a photograph, painting, sculpture or mixed media (“Art Work”) to Zinc to be considered for publication in an upcoming edition of Filament.

2.  How to Submit: You can submit your Essay or Art Work (a “Work”) by emailing a copy of your Work to Zinc at  submissions@zinc.nyc. You may submit up to four Works. Zinc is not responsible for any lost, misdirected, corrupted, improperly formatted or unprocessed Works.  Zinc is not responsible for any Works that become lost or damaged for any reason. Zinc will not confirm receipt of any Works, catalog or coordinate multiple entries, provide copies of any Works or be responsible for archiving of any Works.

3.  Your Works: By submitting a Work, you, and if you are under the age of 18, your parent or guardian, warrant and represent that (i) you are the sole author of the Work; (ii) the Work is original to you; (iii) you own all intellectual property and other rights in and to your Work; (iv) the Work does not infringe anyone’s copyrights or other intellectual property rights; and (v) the Work is free and clear of any third-party claims of copyright, ownership, authorship or any other intellectual property right. All intellectual property and any other property rights in any Work that belongs to an author will remain with the author submitting it. Zinc reserves the right to edit all Essays selected for publication for punctuation, grammar, spelling and clarity.

4.  Selection of Works:  Zinc, in its sole discretion, will determine which submitted Works are published, the timing of the publication of Works and the placement of Works within Filament.

5.  Release:  If a Work is selected for publication, the author of the selected Work or the authors’ parent or guardian if the author is under the age of 18, will be required to sign and return to Zinc, (i) a publicity/liability release (the “Release”) unless prohibited by law and (ii) a royalty free, non-exclusive license to Zinc to use the author’s Work in Filament and on Zinc’s website. No Work will be published without Zinc’s receipt of a properly completed Release.

6.  General:  Zinc shall be deemed sole interpreter of the rules and conditions governing the submission and publication of Works. By submitting a Work, an author or the author’s parent or guardian if author is under the age of 18, acknowledges and agrees to be bound by these rules and that the decisions of the Zinc regarding submissions and publication are final. This program is void where prohibited by law. Zinc reserves the right, in its sole discretion, to cancel, terminate or suspend accepting and publishing Works at any time for any reason.

7.  Dispute Resolution:  Except where prohibited, as a condition of submitting a Work, each author or the author’s parent or guardian if the author is under the age of 18, agrees that any and all disputes which cannot be resolved between the parties, claims and causes of action arising out of or connected with the submission and publication of one or more Works shall be resolved individually, without resort to any form of class action. Further, in any such dispute, under no circumstances will author be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental or consequential damages, or any other damages, including attorneys’ fees, and each author further waives all rights to have damages multiplied or increased. All disputes relating to or arising under these rules, the submission of a Work or the publication of a Work shall be governed by and construed in accordance with the laws of the State of New York, U.S.A. without giving effect to the conflict of laws rules thereof and any matters or proceedings as set forth in these terms, shall be heard by a State or Federal court located in the State of New York, County of New York. The parties waive rights to trial by jury in any action or proceeding instituted in connection with any dispute arising hereunder.

8. Data Privacy:  Each author or the author’s parent or guardian if the author is under the age of 18, agrees that personal data, including name, age and contact information, may be processed, stored and otherwise used for the purposes and within the context of the submission, selection and publication of a Work. The data may also be used by Zinc in order to check authors' identity, their postal or email address and telephone number, or to otherwise verify their eligibility to submit a Work. Authors have a right to access, review, rectify or cancel any personal data held by the Zinc by writing to Zinc at 41 Union Square West, Suite 602, New York, NY 10002.  If an author's data required for publication is not provided or is canceled, the author’s Work will not be published.     

9. Elimination:  Any false information provided within the context of a submission or related to a Work by any author concerning identity, postal or email address, telephone number, ownership of right or noncompliance with these rules or the like will result in the author’s Work not being published or removed from publication. Zinc further reserves the right to not publish or remove from publication any Work that it believes, in its sole and unfettered discretion, infringes upon or violates the rights of any third party.

10. Severability: If any provision(s) of these terms are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect.
